What is the difference between sexual harassment and sexual assault?

The term sexual harassment broadly refers to any verbal or physical attention of a sexual nature that is unwanted by the victim. In contrast, sexual assault requires actual contact of an insulting or provoking nature without the victim’s consent.
Typically, sexual harassment can be charged as a criminal offense, but sexual harassment litigation is almost always litigated in civil court. In civil court, a plaintiff victim has a greater ability to dictate the outcome of litigation, i.e., obtaining a financial settlement from the defendant-aggressor.
How is sexual misconduct defined in California?
Like sexual harassment and sexual assault, sexual misconduct consists of a wide array of sexually offensive behavior. Sexual misconduct includes such acts as harassment or date rape, dating violence, sexual exploitation, intimate partner violence, and stalking, among others.

What should I do if I have been sexually assaulted?
If you have been sexually assaulted, the first step to take is to move yourself to safety. Once you are safe, you should seek immediate medical help. Most hospitals or medical centers employ nurses who are trained in handling victims of sexual assault, both from a medical standpoint and from an evidence collection standpoint. This is important because it is difficult to prosecute sexual assault cases without evidence.
Next, you should report the attack, either through the police or other resource for victims of sexual assault, such as a hotline. The latter can be done anonymously. Importantly, while reporting the assault to police is helpful, it is not required to pursue a civil lawsuit for sexual assault.
It is also important to save evidence, even if you do not immediately report the assault or seek medical attention. Items such as clothing worn during the attack, text messages, or anything else related to the assault.

In the United States, sexual assault cases can be prosecuted in two ways, as a criminal matter by the government, or a civil matter between private individuals. In a criminal case, the prosecutor has discretion to determine whether the bring sexual assault charges against the attacker.
Many times, a prosecutor may elect not to do so because the burden of proof is higher in a criminal case versus a civil case. For that reason, a not guilty verdict in criminal court does not mean the attacker will not be held liable for your injuries in civil court.
